What is a postnup?
A postnuptial agreement is a written contract between spouses, signed after the wedding. It works much like a prenup by defining how property, debts, and support are handled, but it reflects where your marriage is today. We make sure it meets California's stricter standards for spouses.
Why couples get a postnup
We help spouses who:
Didn't get a prenup and now wish they had
Are starting or growing a business
Received or expect an inheritance
Have had a significant change in income or career
Are reconciling and want a fresh, clear foundation
Want to clarify what's separate and what's community property
What a postnup can cover
We draft postnups that address:
Classifying property as separate or community
Converting property from one type to the other (called a "transmutation," which must be in writing and meet legal requirements)
Business ownership and growth
Responsibility for debts
Spousal support terms
Rights at death
This isn't our policy; it's California law. No postnup, no matter who drafts it, can decide child custody or limit child support. California courts always decide those based on the child's best interests at the time.
What makes California postnups different
In California, spouses owe each other a fiduciary duty, the highest duty of good faith and fair dealing. Courts look closely at postnups, especially when one spouse benefits more. To help your agreement hold up:
Both spouses fully disclose their finances
Each spouse has their own attorney
The terms are fair and entered into freely, without pressure
We build every postnup around these requirements so your agreement is as strong as possible.
How we prepare your postnup
Free consultation. We discuss your goals, your situation, and what matters most to you.
Financial disclosure. You and your spouse exchange complete information about assets, debts, and income.
Drafting. Niki prepares an agreement tailored to your situation. (If your spouse's attorney drafted it, Niki reviews it instead and advises you.)
Review and negotiation. The other side's attorney reviews it, and we work through any changes.
Signing. You sign once everyone is comfortable.

Frequently asked questions
Are postnups enforceable in California?
Yes, when they're done properly. That means full disclosure, fair terms, voluntary agreement, and ideally each spouse having their own attorney.
Does my spouse need their own attorney?
We strongly recommend it. Niki can represent only one spouse, and having separate attorneys makes the agreement much stronger.
Can Niki review a postnup my spouse's attorney drafted?
Yes. We review postnups drafted by the other side, explain each term, and negotiate changes on your behalf.
Can we change or cancel it later?
Yes. Spouses can amend or revoke a postnup by signing a new written agreement.
How long does it take?
It typically takes a few weeks to a couple of months, depending on how complex your finances are and how much negotiation is involved.
How much does it cost?
We offer flat fees on most agreements, so you know the cost up front. Contact us for a free consultation and quote.
Ready to get started?
Tell us about your situation and we'll explain how we can help with your postnup. The consultation is free, and most agreements are flat fee.
